Tutor Terms - Terms and Policies Specific to Service Providers - 619-955-6700

By providing services, you grant that you have read, understand, and agree to the following

TUTOR TERMS OF SERVICE (rev. Oct 2008)
All provisions in the TERMS OF USE AGREEMENT are applied to this Terms of Service Agreement. If any provision is found to be in conflict with the Terms of Use Agreement, the provision in this Terms of Service Agreement will supersede.
The Company provides a service to tutors by matching them with its customers ("students") in need of tutoring services. The Company provides this service without regard to race, color, religion, sex, national origin, age, veteran status or disability. By utilizing this service and providing tutoring services to such customers, you acknowledge that no relationship of employment, partnership or joint venture agreement is expressed or implied. The Company does not offer or supply to those who utilize this service benefits which are legally mandated for employees, including but not limited to unemployment insurance, workman's compensation, overtime, paid vacations, retirement plans, etc. Any tutor using our service is financially responsible for any and all expenses they may incur, including licensing fees and Federal, State and Local taxes owed for compensations paid to the tutor by The Company.

The Company does not guarantee the tutor will be supplied with any certain number of students or be able to work a minimum number of hours per week or month. The Company may provide generalizations of how much the tutor might expect to work, however such estimates are solely based upon previous and current trends and The Company cannot accurately predict the volume or quality of future services for the tutor. The Company is not responsible for supplying a minimum amount of income to the tutor, and should not be relied upon as the sole provider for income to provide for their debts or other financial responsibilities. Furthermore, The Company does not reimburse tutors for transportation, fuel, registration, insurance, supplies, tuition, relocation, licensing fees, or other expenses relating to the services they provide The Company or its customers.

The tutor will only be paid for services which The Company has collected for from their respective students. The tutor is responsible for knowing and keeping the customer aware of their current balance. If payment is required, the tutor must verify a payment has been made before further services are provided. The tutor promises to promptly deliver to The Company any and all payments given to the tutor for services, unless the entire payment is clearly understood by all parties as driving compensation or gratuity. The tutor will not ever hold onto a payment made to The Company as collateral for discrepancies from any related or unrelated payments or accounts between The Company, tutor and/or customer. The Company will withhold one hour of tutor compensation for services with each customer that has a positive balance of tutoring credits until services to the customer by the tutor are finished. In no case will monies withheld be paid out if the tutor ceases to provide services to a customer with a positive balance without notifying the customer and The Company at least 7 days in advance.

Tutors may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, material, software, products or services without explicit permission provided directly from The Company's head management. The tutor agrees to keep confidential all Proprietary Information and all personal information regarding students, parents, customers, clients, company personnel, etc. The tutor grants permission to have a background check performed by The Company, its affiliates, or current and potential customers interested in receiving services from the tutor. The tutor agrees to provide complete and truthful information to The Company, its affiliates, and all customers on all documents and during all communications without exception.

Tutors understand their profile, and the information contained within, will be posted on the website in the public domain. No tutor is to use profanity or other controversial language or ideas which viewers might find offensive; such conduct is a violation of our terms and proper action may be taken. Tutors may submit content, such as original statements and personal information, in their application or on our website to help attract customers to the tutor's profile. By doing so, the tutor grants The Company permission to edit, copy, publish, distribute, translate and otherwise use in any medium this content without limit or compensation.

The Company reserves the right to discontinue the use of a tutor and to reassign students at anytime with or without cause. If the tutor ceases to us the services provided by The Company or promptly upon The Company's request, the tutor agrees to deliver to The Company all copies of any and all materials and writings received from, created for, or belonging to The Company including, but not limited to, those which relate to or contain Proprietary Information, Content, or Company Records that are in the tutor's possession or under the their control. The tutor also agrees to promptly destroy any additional copies, electronic or otherwise, of such property.

Any tutor utilizing this service agrees not to use any information provided to them by The Company, including but not limited to personal contact information belonging to students and their families or to other tutors, in any way that may be competitive with The Company while the tutor utilizes this service and for a period of two years following. Notwithstanding this provision, the tutor is allowed to provide services to students who do not have a current or previous relationship with The Company and to promote or advertise their services elsewhere so long as no use of property or information belonging to The Company is involved.
